Understanding the Contract

Why Most “Estimates” Aren’t What You Think They Are

Almost every builder in the residential market — including most of the ones you’ll interview — works on what’s called cost-plus, sometimes labeled “time and materials” or “open book.” Under this model, the number in your estimate is just that: an estimate. It has no contractual relationship to what you’ll actually pay.

You’ll pay the builder’s actual costs — labor, materials, subcontractors, change orders, and anything the builder decides was “unforeseen” — plus a markup. Whether the final number matches the estimate depends entirely on how accurate the estimate was. In practice, the final number is almost always higher. Often substantially higher.

This model exists for a reason. It lets a builder start your project quickly, without requiring the pre-construction work that a fixed price demands. That’s a legitimate choice, and some clients prefer it. But it should be an informed choice, and most homeowners don’t realize they’re making it.

What We Offer Instead: A Fixed-Price Contract

We do the pre-construction work. Everything that can be scoped, priced, and documented is — before a contract is signed. The number in your contract is the number you pay, contractually, for the scope you signed.

Three things can move that number, and all three are handled the same way — visibly, in writing, and with your authorization before the work proceeds.

Scope or plan changes. If you decide to add something, change something, or expand something mid-project, we issue a written change order showing the cost impact. You approve it before we act on it.

Allowances. Some selections — certain finishes, fixtures, and materials — aren’t finalized at the time we sign. The contract carries an allowance for each, and your actual cost lands above or below that allowance depending on what you choose. You see the difference at the moment of selection.

Unforeseen conditions. Genuinely concealed issues discovered during construction — structural damage behind a wall, solid rock during excavation, a concealed condition no one could have seen. Handled the same way as a change order: written, itemized, authorized by you before the work proceeds.

The point isn’t that a fixed-price contract eliminates every variable. It doesn’t, and any builder who claims otherwise must either be less than forthcoming, or charging you a hidden premium to cover the risk. The point is that under a fixed-price contract, every variable is named, bounded, and under your control at the moment it matters. Under cost-plus, every cost can change for any reason at any time. That’s the difference.

You Still Have a Choice

We offer both models. If you prefer cost-plus — faster start, no fixed scope, flexibility to decide things as you go — we’ll do that well, and we’ll be honest with you about what it means.

We don’t have a preference between the two. We care that you understand what you’re picking, and why. The rest is your call.
